Navigating Maryland’s Cannabis Legalization: Key Guidelines and Benefits for Medical Patients

We’re entering an exciting new era for cannabis in Maryland, and we want to make sure you’re informed and ready! As you know starting July 1, 2023, the possession and use of small amounts of cannabis and cannabis products will be legal for adults over 21.
Here’s a quick rundown of what you’ll be allowed to possess: up to 1.5 ounces of cannabis; up to 12 grams of concentrated cannabis; cannabis products containing up to 750 milligrams of delta 9 THC; up to 2 cannabis plants.
 
Please note that possessing amounts beyond these limits could result in civil or criminal penalties. You can find more details about these penalties in Md. Code, Criminal Law §§ 5-101, 5-601 and 5-601.1.
 
Moreover, adults will be allowed to grow up to two cannabis plants at their residence from July 1, 2023. The plants must be secure and out of public view. Also, remember that only two plants are allowed per residence, irrespective of the number of adults living there. For more information, refer to Md. Code, Criminal Law § 5-601.2.
 
Also, from July 1, 2023, sharing of cannabis will be allowed between adults 21 years or older, provided that it doesn’t exceed the defined amount for personal use and that no money is exchanged for it. Be mindful that violating these terms may lead to criminal charges and potential penalties. For further information, refer to Md. Code, Criminal Law § 5-602.

As we’ve mentioned transitions of this nature can potentially lead to longer wait times, product shortages, and more. We also want to highlight the advantages of remaining a medical cannabis patient. Firstly, medical cannabis products will continue to be untaxed, making them less expensive than recreational products which will incur a 9% tax. In addition, medical patients will continue to receive their standard allotment of 120/36 grams of flower/THC, significantly higher than the 42.5/12 grams limit set for recreational purchases. Lastly, while the range of products available for recreational use will be limited to flower, vapes, and gummies with smaller amounts of THC, medical patients will retain access to the full range of products, including concentrates, waxes, and oils.
